Why might a credit card be unenforceable?
If a credit card agreement is found to be unenforceable then a lender cannot use the courts to pursue the debt.
A lender must be able to provide a ‘true copy’ of the credit agreement you signed in order to be able to enforce the debt.
Should a lender provide a ‘true copy’, but this shows that the agreement did not comply with prescribed terms of the Consumer Credit Act, or created an unfair relationship, then the agreement could be found to be ‘irredeemably unenforceable’
The objective of a credit card claim is to establish whether a debt is unenforceable and, if this is found to be the case, for the lender or court to write off the debt. Equally, during the investigation other areas of claim may be discovered. A successful outcome may therefore consist of:
- A completely written off balance
- Financial compensation
- Both of the above
